These terms and conditions apply to the use of www.braecycling.com website. By using the website and/or placing an order with us you agree to be bound by these terms and conditions.

The terms and conditions are subject to change from time to time so please always check them before ordering any products.

If you do not agree with the terms and conditions set out below, you should not use our website.

To be eligible to lawfully enter into a contract with us to purchase products on our website you must:

Be the holder of a valid debit/credit card or PayPal account.
Agree not to impersonate any other person or entity or use a false name or a name that you are not authorised to use.

Product specifications can be found on the relevant product webpage.

BRAE Cycling reserves the right to alter specifications from those stated. This does not affect your statutory rights.

PRICE

All prices displayed for products available on www.braecycling.com are inclusive of VAT at the current rates and are stated in pounds sterling. These prices are exclusive of delivery charges. The total cost of your order is the price of the products ordered (less any promotional discount, if applicable) and the delivery charges.

PROMOTIONAL DISCOUNT

We do offer promotional discounts from time to time. To use one, please enter the code within the applicable box on the website order page, which will automatically update the price of the product ordered.

ORDER

You will receive an email acknowledgment confirming receipt of your order shortly after its submission by you. However, please note that this does not constitute an acceptance of your order. A contract between us shall not be formed until we send a confirmation email declaring the dispatch of your order.

PAYMENT

We accept most major credit/debit cards and also PayPal. All credit and debit cards are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

DELIVERY TIME & IMPORT TAXES

We will deliver your order in accordance with the delivery option selected by you during the order process. Products will be sent to the delivery address provided by you in a timely manner, however the time it takes for delivery shall not form the essence of the contract.

Warranty

Our products come with a 5-year warranty. If your item or develops a problem within 5 years from the date of purchase because of defective materials or poor workmanship we will put it right for you free of charge.

The scope of our warranty does not include any material abrasion, holes or tears that occur as a result of the improper treatment or handling of the product by the purchaser. Brae Cycling accepts no liability for any claims relating to normal wear and tear, improper product use, failures to follow assembly or mounting instructions, product modifications or improper storage. If your product is replaced pursuant to the terms of the warranty, the date of the original purchase shall still apply as the reference date for the 5-year warranty period.

RETURNS & EXCHANGES

If you would like to return your item for a refund or exchange, you can do so within 30 days of receipt. It must be unused, and in perfect condition with all its original packaging and paperwork intact.

LEGAL TITLE

The legal title to the products and the risk in the products will pass to you on delivery of the products.

CLAIMS

Claims arising from damage, delay or partial loss of the products in transit must be made in writing to us here at BRAE Cycling within 7 days of the delivery. You shall afford reasonable opportunity to allow us to investigate any claim. You shall promptly return the products to us being the subject of a claim, if requested by us, for examination.

LIABILITY

We do not accept any liability for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications of listed products and services at any time, without notice.

If an error is discovered in the price of products that you have ordered, we will inform you as soon as possible. We will be under no obligation to fulfil and order for a product or service that was advertised at the incorrect price.

The products sold on our website are provided for domestic and consumer use. We do not accept any liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from any claims of third parties arising out of the use of any products or services purchased.

We have no liability to you for any delay in the delivery of products ordered by you or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock outs, riots, civil commotion, pandemics, malicious damage, explosion, governmental actions and other similar events.

We take care to prevent internet fraud and ensure that any data collected from you is stored in full compliance with GDPR legislation as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in on secure computer servers used by our ecommerce platform providers.

We will not be liable in contract, tort (including, without limitation, negligence), pre-contract or other representations, other than fraudulent or negligent misrepresentations.

LIMITATION OF LIABILITY

Our total liability for any claim howsoever arising shall not exceed the purchase price for the products supplied by us to you, together with any postage costs incurred. We shall not be liable for any injury (other than death or personal injury) damage or loss, including consequential customer loss whether this arises from a breach of duty of contract or in any other way.

Nothing in these terms and conditions will exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

We assume no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer, telecommunication equipment, or other property caused by or arising from your access to, use of, or browsing this website or your downloading of any of the materials, from this website.

INTELLECTUAL PROPERTY & TRADEMARKS

All trademarks, registered or unregistered design rights, copyrights, confidential information, photographs, sketches, images narratives, knowhow and other intellectual property rights of any nature in all products and materials supplied by us are owned by BRAE Cycling.

GOVERNING LAW

This Contract, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, Laws of Scotland and the parties hereby submit to the exclusive jurisdiction of the Scottish Courts.
